Design Made Clear operates this shop and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Design Made Clear is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Design Made Clear specializes in digital products. No physical items will be shipped unless otherwise stated. We make every effort to represent our products accurately. However, colors, appearance, or display may vary depending on your device.
All product descriptions are subject to change without notice. We reserve the right to discontinue products or limit quantities at our discretion.
SECTION 3 - KDP AND DIGITAL PUBLISHING PRODUCTS
Design Made Clear offers templates, guides, training materials, and educational resources intended to assist with self-publishing on platforms such as Amazon Kindle Direct Publishing (KDP). By purchasing any such product, you acknowledge and agree to the following:

Customization Requirement: Templates, interiors, covers, and related files included in any kit or bundle are sold to multiple buyers and are provided as a creative starting point only. You are solely responsible for substantially customizing all templates — including but not limited to fonts, layouts, graphics, colors, and text — before uploading to Amazon KDP or any other publishing platform. Templates must not be used, uploaded, or published in their original or minimally modified form. Uploading templates without meaningful, substantial customization may result in rejection, content flags, removal, or account suspension by Amazon KDP or any other platform. Design Made Clear is not responsible for any such outcomes.
No Guarantee of Approval, Publication, or Results: Design Made Clear makes no guarantee that any book, file, cover, interior, or content created using our products will be approved, published, remain live, or generate sales on Amazon KDP or any other platform. Platform policies change frequently and all approval decisions are entirely at the discretion of the respective platform. Your results will depend entirely on your own customization, publishing decisions, marketing efforts, and compliance with platform guidelines.
Account Actions: Design Made Clear is not responsible for any account warnings, suspensions, bans, restrictions, or other actions taken by Amazon KDP or any third-party platform as a result of your publishing activity, your customization choices, or your failure to comply with platform guidelines. You assume full responsibility for all consequences of your publishing decisions.
Buyer Responsibility for Compliance: You are solely responsible for reviewing, understanding, and complying with Amazon KDP's current content guidelines, formatting requirements, metadata policies, copyright policies, and publishing terms before uploading any files. Platform guidelines change frequently. It is your responsibility to verify current requirements at the time of upload, regardless of guidance provided in any Design Made Clear product.
Educational Purpose Only: All guides, checklists, walkthrough videos, compliance materials, and written instructions provided by Design Made Clear are for general educational purposes only and do not constitute legal, financial, or platform-specific advice. Design Made Clear makes no representation that following any guide or checklist will guarantee compliance with Amazon KDP's policies at any given time.
AI-Generated and Third-Party Assets: Some graphics, assets, or training materials may reference or involve the use of AI image generation tools or third-party platforms. You are solely responsible for ensuring that any content you create, modify, or publish using AI tools complies with all applicable laws, platform terms, and licensing requirements. Design Made Clear is not responsible for any claims arising from your use of AI-generated content.
Canva and Third-Party Tools: Templates provided in Canva or other design platforms are subject to the terms of service of those platforms. You are responsible for ensuring your use of Canva elements, fonts, images, and graphics complies with Canva's licensing terms and Amazon KDP's content policies. Design Made Clear is not responsible for any rejection or account action resulting from improper use of third-party design elements.
Similarity of Outputs: Use of templates by multiple buyers may result in similar outputs if not properly customized, and Design Made Clear is not responsible for any resulting similarity or platform action.
SECTION 4 - ORDERS
Placing an order constitutes an offer to purchase. Design Made Clear reserves the right to accept or decline your order at its discretion. Your order is not accepted until we confirm receipt and process payment.
Because our products are digital, all sales are final. Please review carefully before purchase. Purchases are subject to our Refund Policy.
SECTION 5 - PRICES AND BILLING
All prices, discounts, and promotions are subject to change without notice. The price at checkout will be the final amount charged, excluding any applicable taxes.
You agree to provide current and accurate purchase, payment, and account information. By submitting payment, you confirm that you are authorized to use the chosen payment method and agree to pay all charges.
SECTION 6 - REFUND AND CHARGEBACK POLICY
Due to the digital nature of all products sold by Design Made Clear, all sales are final. Refunds will not be issued once access or download links have been delivered, regardless of whether the product has been used or the outcome of any publishing attempt.
If you initiate a chargeback or payment dispute with your bank or payment provider rather than contacting Design Made Clear directly, Design Made Clear reserves the right to suspend or permanently revoke your access to all purchased products and future purchases, and may pursue recovery of the disputed amount plus any fees incurred as a result of the chargeback. You agree to contact Design Made Clear first at info@designmadeclear.com to resolve any billing concerns before initiating a dispute with your payment provider.
No refund will be issued on the basis of Amazon KDP rejection, account suspension, account ban, or any other platform action. These outcomes are outside the control of Design Made Clear and are the sole responsibility of the buyer.
SECTION 7 - DELIVERY OF DIGITAL PRODUCTS
All products are delivered digitally. Upon successful payment, you will receive access or download links via email or platform access. Design Made Clear is not responsible for issues caused by your device, software, internet connection, or failure to provide a valid email address. Please check your spam or junk folder if you do not receive delivery confirmation.
SECTION 8 - EARNINGS DISCLAIMER
Any references to income, revenue, earnings, sales, or results — whether in product descriptions, testimonials, case studies, social media, or marketing materials — are illustrative examples only and are not guarantees. Your results will vary based on your individual effort, customization, publishing decisions, marketing, market conditions, and many other factors outside the control of Design Made Clear.
Design Made Clear makes no representation that any particular income or result is typical, expected, or guaranteed. You accept full responsibility for your publishing, business, and financial decisions and outcomes.
SECTION 9 - INTELLECTUAL PROPERTY
All products, content, and materials available through Design Made Clear remain the intellectual property of Design Made Clear unless otherwise stated in the product license.
You may not reproduce, distribute, modify, or resell our products except as expressly permitted by the license included with your purchase. Templates are licensed for individual personal use only unless a multi-use or commercial license is explicitly stated in the product listing. You may not share, redistribute, or provide access to purchased products to third parties, clients, team members, or virtual assistants without purchasing the appropriate license.
SECTION 10 - OPTIONAL TOOLS AND THIRD-PARTY PLATFORMS
We may provide access to or references to third-party tools, platforms, or resources including but not limited to Canva, ChatGPT, OpenAI, Amazon KDP, Midjourney, and others. These are provided for reference and educational purposes only. Design Made Clear makes no warranties regarding third-party tools and is not liable for changes to their pricing, availability, features, terms of service, or any impact those changes may have on products you have purchased from Design Made Clear.
SECTION 11 - THIRD-PARTY LINKS
Our Services may include links to third-party websites. We are not responsible for content, accuracy, or transactions on those websites. Please review their policies before engaging.
SECTION 12 - RELATIONSHIP WITH SHOPIFY
Design Made Clear is powered by Shopify, but all sales are made directly with Design Made Clear. Shopify is not responsible for any issues, claims, or damages related to purchases from our shop.
SECTION 13 - PRIVACY POLICY
Your personal information is governed by our Privacy Policy. Because we are hosted by Shopify, your information may also be subject to Shopify's Privacy Policy.

Design Made Clear does not warrant that use of any product will result in approval by Amazon KDP or any other third-party platform.
SECTION 19 - LIMITATION OF LIABILITY
To the maximum extent permitted by law, Design Made Clear, its owners, affiliates, and partners are not liable for any direct, indirect, incidental, special, consequential, or punitive damages related to the use of our Services or digital products, including but not limited to account suspensions, bans, rejections, lost revenue, or lost business opportunities on any third-party platform.
In no event shall Design Made Clear's total liability to you for all claims arising from or related to any product exceed the total amount you paid to Design Made Clear for that specific product.
SECTION 20 - INDEMNIFICATION
You agree to indemnify and hold harmless Design Made Clear, its owners, employees, agents, Shopify, and affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from your use of our Services, your publishing activity on any platform, your violation of these Terms, or your failure to comply with any third-party platform's guidelines or policies.
SECTION 21 - DISPUTE RESOLUTION AND ARBITRATION
Any dispute, claim, or controversy arising out of or relating to these Terms or the purchase or use of any product shall first be attempted to be resolved through informal negotiation by contacting Design Made Clear directly at info@designmadeclear.com. If the dispute cannot be resolved informally within thirty (30) days, you agree that any remaining dispute shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, rather than in court.
Arbitration shall take place in the State of New Jersey, and the arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court having jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Design Made Clear.
By purchasing a product from this shop, you agree that Design Made Clear, Amanda Pena Design LLC, and any associated parties are not responsible for legal claims, fines, damages, or issues that may come from using these materials.
SECTION 22 - SEVERABILITY
If any provision is found unenforceable, the remaining provisions will continue in full effect.
SECTION 23 - WAIVER; ENTIRE AGREEMENT
Failure to enforce any right or provision does not constitute a waiver. These Terms and our policies constitute the entire agreement between you and Design Made Clear with respect to your use of our Services.
SECTION 24 - ASSIGNMENT
You may not assign your rights under these Terms without our written consent. Design Made Clear may assign its rights without notice.
SECTION 25 - GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in the State of New Jersey.
SECTION 26 - FORCE MAJEURE
Design Made Clear shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, internet outages, platform outages, acts of third-party service providers, changes to third-party platform policies, or any other force majeure event.
SECTION 27 - CHANGES TO TERMS OF SERVICE
We may update these Terms from time to time. Changes will be effective immediately upon posting. Continued use of our Services after changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically. Last updated: April 2026.
